How Often Can I File Bankruptcy in Arizona?
Have you ever asked yourself this question? If so, You are not alone! The current Arizona bankruptcy law allows you to file for Chapter 7 Bankruptcy protection in Arizona once every eight (8) years, up to three (3) different times in your life. There is no limit on how many times you can file a Chapter 13 bankruptcy in Arizona. You can receive a discharge from Chapter 7 bankruptcy once every eight years and from Chapter 13 bankruptcy every two years.
The actual law reads:
Under the bankruptcy laws effective on October 17, 2005, Chapter 7 cannot be filed unless the debtor was discharged from the previous Chapter 7 or bankruptcy more than eight years ago.
The debtor cannot file a Chapter 13 unless: (1) the debtor received a discharge under Chapter 7, 11 or 12 more than four years ago; or (2) the debtor received a discharge under Chapter 13 more than two years ago.
NOTE THE ABOVE ARE DISCHARGE DATES
Declaring bankruptcy can help individuals and businesses get back on the right track. However, sometimes financial troubles appear again. If you are in this situation, it may help to know that you may be able to file for bankruptcy again even if you filed within the past eight years. If you have filed for bankruptcy protection in Arizona within the last eight years, there are still options! You still may be eligible to file for another bankruptcy under another chapter of the bankruptcy law. An experienced bankruptcy attorney can help you learn more about your options for a second bankruptcy.
